Dear Councilman Ash Kalra,

Thank you for your quick response to my complaint letter. Your replies, in fact, made me even unhappy by the following points:

First, your letter said: ... "After the event, I checked with my staff, and they were not instructed by anyone else in this manner and never asked anyone to remove the flag." I hope by replying that, you don't mean I'm a liar. I had witnesses who knew and saw the incident that I can now list one of them who is Mrs. Van Lan Truong (Supervisor Chavez's staff). Ms. Van Lan Truong knew your staff asked me to remove my neck chain, not allowing me to wear it to come into the Council Chamber. Mrs. Van Lan Truong tried to ask your two staffs to return the chain & let me get in the Chamber, but she could not resolve it after all. You can check with Mrs. Van Lan Truong how the story took place.

Second, your letter doesn't get straight to the issue that I complained about. My letter mentioned the neck chain that I was wearing, which has the symbol of Vietnamese Freedom Flag, not the whole flag all by itself. (See attached pictures for their difference please). I only wore that little neck chain; I didn't bring in a FLAG. My letter simply to protest how your office staffs violated my basic human rights by asking me to remove my little neck chain, which has an honor symbol of Vietnamese Freedom Flag, not an bad cause nor terrorist symbol.

I know that the City of San Jose officially approved Vietnamese Freedom Flag through a Resolution. That is why I could not understand such an undemocratic act was done in City Hall Council Chamber, under your organizing/management on the event of Mr. Ambassador Osius openly held meeting with Viet community. This made me, and many community members wonder if your staff’s action would come from Mr. Ambassador himself as he had publicly expressed that he could not be seen with the Vietnamese Freedom Flag because he's an official US diplomat.

If this undemocratic order/instruction truly came from Mr. Ambassador Osius, then on behalf of my community, I like to provide to you, my councilman, so you can pass it on to your staffs and to whoever blindly listened to Mr. Osius, the attached picture which shows our former U.S. Ambassador to Vietnam, Mr. David Shear, who was Mr. Osius’ predecessor stood under our Vietnamese Freedom Flag in a community meeting in May 2013 in Little Saigon Orange County.

Cám ơn ông đã phản ứng nhanh chóng thư khiếu nại của tôi. Sự trả lời của ông làm tôi không hài lòng bởi những điểm sau đây:

Đầu tiên, thư của ông nói rằng: ... "Sau sự kiện này, tôi đã kiểm tra với nhân viên của tôi, và họ không được hướng dẫn bởi bất cứ ai khác theo cách này và không bao giờ yêu cầu ai để loại bỏ các lá cờ." Tôi hy vọng ông không có cho tôi là một kẻ nói dối. Tôi có nhân chứng đã thấy và biết sự việc mà tôi có thể liệt kê như là bà Vân Lan Trương (nhân viên của Giám sát viên Cindy Chavez). Bà Vân Lan Trương biết nhân viên của ông hỏi tôi để tháo bỏ dây đeo cổ của tôi, không cho phép tôi đeo nó để đi vào phòng họp. Bà Vân Lan Trương đã cố gắng để yêu cầu hai nhân viên của ông trả lại dây đeo cổ của tôi, nhưng bà  không thể giải quyết được. Ông có thể phối kiểm với bà Vân Lan Trương sự việc đã diễn ra.

Thứ hai, thư của ông không đi thẳng vào vấn đề mà tôi phàn nàn. Lá thư của tôi đã đề cập đến dây đeo cổ mà tôi đã mang, trong đó có biểu tượng của lá cờ Việt Nam Tự Do, không phải là nguyên lá cờ. (Xem hình ảnh đính kèm để biết sự khác biệt). Tôi chỉ mang một dây đeo cổ nhỏ; Tôi đã không mang vô một lá cờ. Lá thư của tôi chỉ đơn giản là để phản đối về nhân viên văn phòng của ông đã vi phạm nhân quyền căn bản của tôi bằng cách yêu cầu tôi để tháo bỏ dây đeo cổ rất nhỏ của tôi, trong đó có một biểu tượng danh dự của cờ Việt Nam Tự Do, không phải là một biểu tượng khủng bố.

Tôi biết rằng thành phố San Jose đã chính thức công nhận cờ Việt Nam Tự Do thông qua một Nghị quyết. Đó là lý do tại sao tôi không thể hiểu được lại xảy ra một hành động phi dân chủ đã diễn ra ngay trong phòng hội trường của Hội đồng thành phố, qua sự kiện ông Đại sứ Osius công khai tổ chức cuộc họp với cộng đồng người Việt tỵ nạn cộng sản. Điều này làm cho tôi, và nhiều thành viên cộng đồng tự hỏi, hành động này của nhân viên thuộc văn phòng ông đến từ ông Đại sứ vì ông Đại Sứ đã công khai bày tỏ rằng ông không thể được nhìn thấy đứng chung với lá cờ Tự Do Việt Nam vì ông là một nhà ngoại giao chính thức của chính phủ Mỹ.

Nếu chỉ thị hay hướng dẫn hành động phi dân chủ này thực sự đến từ ông Đại sứ Osius, thì tôi thay mặt cho cộng đồng của tôi, tôi muốn cung cấp cho ông, nghị viên của tôi, để ông có thể chuyển đến nhân viên của ông và bất cứ ai mù quáng nghe theo lệnh cua3e ông Osius, các hình ảnh đính kèm trong đó cho thấy cựu Đại sứ Mỹ tại Việt Nam, ông David Shear, là người tiền nhiệm của ông Osius đã đứng dưới lá cờ Tự Do Việt Nam của chúng tôi trong một cuộc họp cộng đồng tháng 5 năm 2013 tại Little Saigon Quận Cam.

Yesterday you sent an email to Councilman Ash Kalra about the event at City Hall with Ambassador Osius.  I did not identify the person who asked you to remove your neck chain as a member of Council Member Kalra’s staff.  In fact, I did not know who that person was.

Dear Ms. Do Minh Ngoc,

Thank you for attending the town hall with Ambassador Osius.  It has come to my attention that you had some concerns that you shared with Councilmember Kalra, as to why you were asked to remove your lanyard depicting the Vietnamese Freedom Flag.

First and foremost Ambassador Osius, Congressman Honda, and Councilmember Kalra have nothing but the utmost respect for the Vietnamese Freedom Flag.  They all share your conviction for human rights for all individuals.  All three are committed to fighting for the rights of all individuals here in America and abroad.  Thank you for your continued work to fight for those that cannot fight and do not have a voice.

The town hall was officially a U.S. State Department event. Thus, we had to abide by the requests of the U.S. State Department.  Our office was told by the State Department that the Ambassador could not be pictured with any symbol of the Vietnamese Freedom Flag.  This was not because he did not respect it, but rather because of his role as a diplomat.  He can only be an ambassador as long as the Vietnamese government allows him to be there.  Having him pictured with any symbol of the Vietnamese Freedom Flag could potentially jeopardize his role as ambassador and undermine his ability to advocate for increased human rights in Vietnam.  Since there were numerous photographers present at the event, the Ambassador did not want to risk being accidently photographed with any representation of the Vietnamese Freedom Flag and potentially undermining his relationship with the Vietnamese government.  As he mentioned in the town hall, he has nothing but respect for the flag and for your convictions; however, he cannot be photographed with it.  Councilmember Kalra had nothing to do with this decision.

Should you have any concerns with this State Department rule, our office would be happy to pass along any concerns you might have directly to the State Department.  My sincere apologies for any misunderstanding of disrespect for the Vietnamese Freedom Flag; our offices have only respect for the flag and what it stands for.

Tôi có thể bảo đảm với bà rằng tôi đã không chỉ thị nhân viên của tôi để yêu cầu bất cứ ai tháo bỏ lá cờ Tự Do Việt Nam. Sau sự kiện này, tôi đã kiểm tra với nhân viên của tôi và họ đã không được hướng dẫn bởi bất cứ ai khác trong việc này và không bao giờ yêu cầu ai tháo bỏ lácờ vàng. Lần đầu tiên tôi được biết điều này khi câu hỏi được đặt ra với ông Đại sứ và ông đã đề cập đến mối quan tâm của ông về việc bị nhìn thấy chung với cờ vàng trong tư cách của nhà ngoại giao chính thức Hoa Kỳ.

Như bà nói đúng, tôi tự hào mang lá cờ Tự Do Việt Nam tại nhiều nơi sinh hoạt cộng đồng và đã từng tổ chức ngày Tháng Tư Đen tại hội trường thành phố trong hai năm qua với lá cờ Tự Do VN trưngbày nổi bật. Tôi có thể bảo đảm với bà rằng không phải tôi, Thị trưởng, hay cácnghị viên Hội đồng thành phố hoặc bất cứ ai từ nhân viên thành phố của chúng tôi yêu cầu cho việc loại bỏ lá cờ vì nó chính thức được công nhận bởi thành phố của chúng tôi và chúng tôi thường xuyên trưng bày nó trên cơ sở thành phố.

Tôi xin lỗi vì sự tổn thương gây ra cho bà. Lần sau nếu có xảy ra tại hội trường thành phố, xin bà liên lạc trực tiếp với tôi khi nó xảy ra và tôi sẽ giải quyết sự việc.

Dear Councilmember Ash Kaira,

As a member of the Vietnamese-American community, I was invited to the Public Town Hall with the new U.S. Ambassador in Vietnam, Ted Osiers, who visited San Jose on Tuesday, July 14, 2015. The event was organized by your office and took place in San Jose City Council Chamber.

I was very surprised, hurt and felt insulted when your assistants asked me to remove and even confiscate my necklace that has the symbol of U.S. Flag and our Viet Freedom Yellow Flag, in order to enter the Council Chamber. I did not receive a clear explanation why such an undemocratic act, a violation on my basic human rights from your assistants and from you. The invitation letter did not even mention not to bring in the symbol of any flags, let alone this was only the necklace, not the big sign or the flag itself.

You yourself always wear the tie with the logo symbol of Viet Freedom Yellow Flag every time you attend the Vietnamese Community events. You also knew very well that City of San Jose had officially recognized our Freedom Yellow Flag with a Resolution. Why did your assistants take away my necklace that bears our heritage and freedom symbol? We wonder if this undemocratic act came from the Ambassador Ted Osiers order or from your own office initiative.

Members of the Vietnamese-American community and I get hurt, and feel humiliated over this undemocratic act. What policy from San Jose City that prohibits ones entered the City Council Chamber in a public meeting wearing the necklace with symbols of Flag and Viet Freedom Yellow Flag? My community and I feel very unrest and deeply concern about this incident from your office.

I can assure you that I did not instruct my staff to ask anyone to remove the Vietnamese Freedom Flag. I first learned about this when the question was asked of the Ambassador and he made mention of his concern about being seen with the flag as the official US diplomat.

As you correctly mentioned, I proudly wear the Vietnamese Freedom Flag at many community gatherings and have hosted the Black April event at city hall for the last two years with the Freedom Flag prominently displayed. I can assure you that neither I, the Mayor, Council Members or anyone from our city staff would ask for the removal of the flag since it is formally recognized by our city and we routinely display it on city premises.

I apologize for the pain caused by the incident that occurred to you. Next time that happens at city hall, come directly to me when it happens and I will rectify the situation.
