RESOLUTION NO. 77202
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN JOSE REGARDING RELATIONS BETWEEN THE CITY OF SAN JOSE AND THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF VIETNAM
WHEREAS, the vast majority of American citizens and residents of Vietnamese descent residing in the United States, and particularly in San Jose, reject the current dictatorial rule of the Vietnamese Communist Party; and
WHEREAS, many citizens and residents of Vietnamese descent residing in San Jose risked their lives to escape from communist-occupied Vietnam following the fall of South Vietnam on April 30, 1975, and came to the United States in their search for freedom and democracy; and
WHEREAS, visits and proposed visits by representatives or officials of the Socialist Republic of Vietnam to regions where there are large concentrations of Vietnamese- American citizens and residents have been met with angry protests and demonstrations; and
WHEREAS, the City has received many requests from the Vietnamese community to adopt a resolution requiring prior notice of visits from delegations from the Socialist Republic of Vietnam because past visits have caused disruptions in other communities requiring police services and causing additional expenses to those communities;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE THAT:
In order to protect the public health and safety of the local community the following actions are adopted:
1. The City Council does not condone, welcome, or sanction high-profile visits, stopovers, or drive-bys by representatives and officials of the Socialist Republic of Vietnam government or that of any delegations affiliated with or organized by the same within the physical boundary of the City of San Jose. The Mayor, Council, City Manager or any of their agent(s) shall not meet with any government delegation or representatives of the Socialist Republic of Vietnam.
2. The City Council is opposed to the expenditure of City funds or resources in a manner that promotes or accommodates visits from any Socialist Republic of Vietnam delegation to San Jose, and the Council expects that any such expenses will be fully borne by the Vietnamese government. This policy statement does not prevent the City from taking appropriate security and public safety measures to protect our own community.
3. The City Council hereby directs the City Manager and Chief of Police to implement a detailed "PRIOR NOTICE" policy of requesting the US State Department and/ or other outside organizers, agencies, and jurisdictions to inform on the nature, purpose, duration of visits, drive-bys, or stopovers of government delegations and affiliated groups from the Socialist Republic of Vietnam, at least fourteen (14) calendar days before such an occurrence.
4. The City Manager and Chief of Police at the earliest available opportunity, shall report to the Mayor and all Council members of such visits, drive-bys, or stopovers, once the notification is made from the requesting organizer, agency or jurisdiction or is made known publicly.
